Terms & Conditions

These Terms & Conditions ("Terms") govern your purchase and use of services from Backstop Digital ("we," "us," or "our"). By purchasing a team recruiting website ("Service"), you agree to these Terms.
1. The Service
For a one-time fee of $250 USD, we will build and deliver a dedicated team recruiting website comparable in features and design to the example shown at naturalssoftball.com. The Service includes:
- Website build: a team recruiting website with player profiles, roster, schedule, and statistics functionality.
- Branding: application of your team's logo, colors, and name to the website.
- One-time data seeding: a single initial import of the team data you provide (roster, player information, schedule). Additional bulk imports after launch are not included.
- 30 days of support: reasonable assistance, adjustments, and bug fixes for 30 calendar days from the date the website is delivered to you.
2. What is not included
- Custom domain registration fees and any third-party hosting fees (we will assist with setup, but third-party charges are your responsibility).
- New features, redesigns, or additional pages beyond the standard website, unless agreed in writing.
- Ongoing content updates — the website is designed for you to manage yourself.
- Support after the 30-day support period (available separately at our then-current rates).
3. Payment
Payment of $250 USD is due in full at checkout and is processed securely by Stripe. We do not store your card details. Prices may change, but the price you pay at checkout is the price you get.
4. Refunds
If we have not yet started work on your website, you may request a full refund within 7 days of purchase. Once work has begun, fees are non-refundable, except that if we fail to deliver a working website as described in Section 1, you are entitled to a full refund.
5. Your responsibilities
- Provide accurate team data, logos, photos, and other content in a timely manner. Delivery timelines depend on receiving your materials.
- Ensure you have the rights and any necessary permissions (including parent/guardian consent for minors) to publish all content, photos, and player information you supply.
- Keep your website login credentials secure.
6. Content and minors
Team websites often feature minor athletes. You are solely responsible for obtaining consent from parents or guardians before providing us with, or publishing, any information about athletes under 18. Upon written request from a parent or guardian, you agree to remove the relevant athlete's information, and we will assist during the support period.
7. Intellectual property
You retain ownership of your team's logo, photos, data, and other content you provide. Upon full payment, you receive a license to use the delivered website for your team's purposes. We retain ownership of the underlying code, templates, and tools, and may reuse them for other clients. We may reference your website in our portfolio and marketing unless you ask us not to in writing.
8. Third-party services
The website may rely on third-party services (such as hosting providers, Stripe, or domain registrars). We are not responsible for outages, changes, or fees imposed by third parties.
9. Warranty disclaimer
Except as expressly stated in these Terms, the Service is provided "as is." We do not guarantee any specific recruiting outcome, college placement, scholarship, search-engine ranking, or level of traffic to your website.
10. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the amount you paid us. We are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or opportunities.
11. Termination
We may decline or discontinue service for any unlawful, abusive, or infringing use. In that case, any unused portion of undelivered work will be refunded on a pro-rata basis.
12. Changes to these Terms
We may update these Terms from time to time. The version in effect at the time of your purchase governs that purchase.
13. Governing law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
